Investigative Subpoena to IGE U.S., a.k.a. Affinity Media

Today we learned that the Florida Attorney General’s Office of
Economic Crimes issued an investigative subpoena for records to IGE
U.S., a.k.a. Affinity Media. The subpoena was issued pursuant to the
Florida Deceptive and Unfair Trade Practices Act in the course of an
official investigation. The subpoena states that the purpose and scope
of the investigation extends to possible unfair and deceptive trade
practices which involve the advertising and marketing practices of
I.G.E. U.S.
The subpoena seeks records relating to the distribution, marketing,
pricing and sale of World of Warcraft gold. The subpoena also seeks
documents relating to the organization and structure of IGE U.S.,
Affinity Media, and IGE Ltd. The subpoena seeks financial and sales
information, the identity of specific World of Warcraft accounts owned
or controlled by IGE, the identity of World of Warcraft accounts that
IGE has power leveled, and the IP addresses IGE used to log into World
of Warcraft to distribute products sold by IGE. The subpoena also
seeks documents which show all websites owned or controlled by IGE or
its affiliates at any time.
While the Florida Attorney General’s investigation of IGE is not
directly related to our IGE v. Hernandez class action, the Attorney
General’s investigation does involve the same cause of action – the
alleged violation of Florida’s Unfair and Deceptive Trade Practices
Act. Newsome Law Firm will follow this investigation with great
interest and keep our class members updated on this investigation
through this web site."

Ouch. Someone somewhere is feeling a swift kick in the nuts.
Expect Blizzard to file in order to obtain information on power
leveled accounts and gold buyers. Many more people may be feeling a
swift kick in the nuts.
Doesn't this also mean that websites like Allakhazam and Thottbot

Allakhazam doesn't feature any gold-selling, and in fact the community
there is very against it.

Ive been admining internet systems for as long as internet has been
internet. And every time I hear someone say something like "no one gets
caught" or "they dont really care" I say that they should always add YET to
the statement.
Internet records everything, internet never forgets, and if its wrong then
eventually someone is going to get around to taking care of it.

Can someone give me the condensed version here please? Exactly what laws
has IGE been suspected of breaking? All I can figure is tax evasion of some

Perhaps there are customers, now, that are paying for gold but not receiving
it. Mailings are being examined, the AH is being watched. Are the IGE
customers who bought gold being given a refund if the gold does not reach
them?

and that they have specifically agreed not to sell (under the terms
and conditions of their warcraft accounts). Hence causes of action
as fraud and unfair/deceptive activities.

What law was broken?
Both the buyer & seller broke a software's terms of use agreement. That's
it, nothing more, nothing less.
No matter how I try to look at this I can see no reason for an attorney
general to issue subpoenas over this. There must be something else going

They have sold something that is not theirs. To sell something is
implying that you own it in the first place and so would come under
the heading "deceptive" in my book. Maybe they are going to try for
that?

Heh, and you are a qualified lawyer with many years dealing in
American Business Law, are you? Leave it to people better qualified,
because otherwise you're just flapping your gums. Think of it as a
trial case covering virtual malpractice, trying to establish a
precedent, then and wait and see, like the rest of us.
A thread full of your "Well I can't see how they can bring a case"
ponderings isn't all that entertaining, and it's going nowhere.

Kill-file me if you don't like my posts or STFU.
I've stated several times I am no legal expert. However, I do have what is
called "common sense", something lacking in this thread. Good example
"Think of it as a trial case covering virtual malpractice..." Florida
Attorney General's issued an investigative subpoena, there is no trial, & no
charges as of yet. I am curious as hell as to why & was hoping someone out
there, maybe even someone with some legal experience could shed some light
on this. This is the only reason I've participated in this thread.
Certainly not to entertain you.
The unrelated class action lawsuit is doomed IMO. However, IGE does have
some worries over this subpoena, but I predict if Florida does anything at

And you've been told why; you just didn't like the answer. They're
investigating
IGE for deceptive and/or unfair trade practices. That would have to be
their
powerleveling, gold/item selling, or character selling practices, along with
their
advertising of those services. Take your pick of which one(s).

Again, the Florida Department of Taxation has their own lawyers; tons of
'em.
They wouldn't go through the state Attorney General's office; they'd use
their
own. They certainly wouldn't use the department which legally only handles
